Disorders in Alehouses

Two Justices may suppress common Alchouses

ORASMUCHE as intollerable hurt and trobles to the Comon Wealthe of this Realme dothe daylie growe and For preventing encrease throughe suche abuses and disorders as are had and used in cõen Alehouses and other houses called Tiplinge houses; It ys therefore enacted by the Kinge our Soveraigne Lorde withe thassent of the Lorde and Comons in this posent Parliament assembled and by thauctoritie of the same, That the Justice of Peace within everie Shire Cittie Boroughe Towne Corporate Fraunchese or Listie within this Realme, or two of them at the lest whereof one of them to be of the Quoą, shall have full power and auctoritie by vertue of this Acte within everie Shire Cittie Boroughe Towne Corporate Fraunchesse and Littye where they be Justices of Peace to remove discharge and putt awaye comon sellinge of Ale and Bere in the said comon Alehouses and Tiplinge houses in suche Towne or townes and place where they shall thinck mete and convenyent; And that none after the firste daye (') next comynge, shalbe admytted or suffred to kepe any comon Alehouse or Tiplinge House but suche as shall be thereunto admytted and allowed in the open Sessions of the Peace, or els by twoe Justice of the Peace, whereof the one to be of the Quos: And that the saide Justice of the Peace or two of them, whereof the one to be of the Quop, shall take bonde and suertie from tyme to tyme by Recognizaunce, of suche as shalbe admytted and allowed hereafter to kepe any comon Alehouse or Tiplinge house, aswell for and againste the usinge of unlaufull Games, as also for the usinge and maynten'nce of good ordre and rule to be had and used within the same, as by their discrecón shalbe thought necessarie and convenient; For makinge of everie whiche Recognizaunce the partie or parties that shalbe so bounde shall paye but twelve pence: And the saide Justice shall tyfie the same Recognisaunce at the next Quarter Sessions of the Peace to be holden within the same Shire Cittie Boroughe Towne Corporate Fraunchesse or Libtye where suche Alehouse or Tiplinge house shalbe; the same Recognisaunce there to remayne of Recorde before the Justice of Peace of that Shire Cittie Borough Towne Corporate Fraunchesse or Littye, uppon payne of forfeyture to the Kinge for everie suche Recognizaunce taken and not Etyfied, thre pounde sixe shillinge eight pence

AND It is further enacted by thauctoritie aforesaide, 'That the Justice of Peace of everie Shire Cittie Boroughe Towne Corporate Fraunchesse and Littye where suche Recognizaunce shalbe taken, shall have power and auctoritie by this Acte in their Quarter Sessions of the Peace, by psentment informacon or otherwise by their discrecon, to enquyre of

None shall keep Alchouses, unless licensed by Sessions, or by Recognizance of Alehouse Keepers for good Order, &c.;

all suche psons as shalbe admytted and allowed to kepe any Alehouse or Tiplinge house, and that be bounde by Recognizaunce as ys abovesaide, yf they or any of them have done any Acte or Act wherby they or any of them have forfeyted the same Recognizaunce: And the saide Justice in evy Shire and Place where they be Justice shall upon everie suche psentiment or informacon, awarde pcesse againste evy suche pson so plented or complayned upon

determine Offences. before them, to shew whie he sholde not forfeyt his Recognizaunce, and shall have full power and auctoritie by this Acte to heare & to determyne the same by all suche waies and meanes as by their discrecón shalbe thoughte good

Persons keeping Alchouses, without

AND It is further enacted by thauctoritie aforesaide, That if any pson or psons, other then suche as shalbe hereafter admytted and allowed by the saide Justice, shall after the saide firste daye of Maye obstynatlye and uppon his owne auctoritie take upon him or them to kepe a comon Alehouse or Tiplinge house, or shall contrie to the comaundment of the saide Justicef or two of them, use comonly sellinge of Ale or Bere, that then the saide Justice of Peace or two of them, whereof one to be of the Quop, shall for everie suche Offence comytt evye suche pson or peons so offendinge to the Comon Jayle within the same Shire Cittie Boroughe Towne Corporate Fraunchesse or Liitye, there to remayne without bayle or maynprise by the space of thre dayes: And before his or their delyveraunce the saide Justice shall take Recognizaunce for him or them so comytted withe two Suerties that he or they shall not kepe any comon Alchouse Tiplinge House or use comonly sellinge of Ale or Bere, as by the discrecon of the saide Justice shalbe seen convenient: And the saide Justices shall make ctyfycate of everie suche Recognizaunce and Offence at the next Quarter Sessions that shalbe holden within the same Shire Cittie Boroughe Towne Corporate Fraunchesse or Libtye where the same shalbe comytted or done, whiche Ctificate shalbe a sufficient conviccon in the Lawe of the same Offence; And the saide Justice of Peace upon the saide Ctyficate made, shall in open Sessions assesse the fyne for everie suche Offence at Twentye shillinges

PROVYDED Alwaye, That in suche Townes and Place where anye Fayre or Fayres shalbe kepte, that for the tyme onelye of the same Fayre or Fayres, it shalbe laufull for everie pson and psons to use comon sellinge of Ale or Bere, in Bothes or other place there, for the relief of the King Subject that shall repayre to the same, in suche lyke manner and sorte as hathe byne used or done in tymes past; This Acte or anye thinge therein conteyned to the cont'rye notwithstandinge
